Decree -Law No. 358/84 of 13 November approved the legal regime for professional cards, that is, it defined the condition for the exercise of professions to the obtaining of special qualifications, with the aim of guaranteeing the health, physical and moral integrity of people or the safety of goods, referring to executive orders the indication of professions subject to such conditioning.
More specifically, this Decree defined some conditions for the granting of a professional card, namely, that obtaining a professional card for the exercise of beauty, body and well-being care professions, including hairdresser, barber, manicurist, pedicurist, calist, beautician, aesthetic masseuse, calist and others, was dependent on passing a professional training course certified by the Institute of Employment and Professional Training (IEFP) and a further set of conditions, in accordance with Order No. 799/90 of 6 September .
However, with the aim of simplifying access to various professions by eliminating mandatory training courses, professional aptitude certificates and professional cards, more recently, Decree-Law No. 92/2011 of 27 July was published , repealing the aforementioned ordinance and Decree-Law No. 358/84 of 13 November.
But what does this mean?
Currently, with the Decree-Law, published in 2011 , it was stipulated that it is not necessary to obtain a professional card to carry out any of the activities previously mentioned, in this context and from this date, without prejudice to future deliberations to be issued by the Commission for the Regulation of Access to Professions (CRAP).
Thus, with the repeal of Decree-Law No. 358/84, the ACT – Authority for Working Conditions stopped issuing Professional Cards, as of 1 August 2011. In addition, the aforementioned Decree-Law did not change the validity of Professional Cards already issued, since they continue to attest to the professional skills for exercising that profession.
